I got ripped off on eBay... THE POLL

if you haven't being reading the other thread let me give you a quick overview:
1: I won a copy of SOS on eBay, the picture showed the record being white with pink splatter (1st Pressing)
2: I recieved a green opaque copy (3rd Pressing)
3: I contacted the seller and he told me he knew the difference but "sold IS sold!" and "you can leave all the negative feedback you want, I don't care"
4: I filed a formal complaint with eBay/Paypal
5: He claims to actually have a SOS White/Pink splatter and will sell it to me
6: I tell him to only contact me through PayPal's resolution center
7: He emails me "Alright. If you drop the case against me I'll refund you the money. This has gone far enough. Let me know."

So what do you guys think I should do? I feel that I will win my PayPal case against him so I would get my money back and this would effect his credit rating, but I would not get my money until the 23rd of December or do I get my money back now?

to make sure this doesn't happent to anyone else, I went through EVERY TGA vinyl listing on eBay and emailed the user to include pressing information on each listing... thanks to Geezfools for keeping and uptodate listing of the discography
