if they are not ripping off someone else's design (photo, lettering, etc.), then I guess it's just their own creation and they can sell it if they like

Sure, it's their design (though I'd be surprised if they owned copyright on the photo of which the design is based) but they're using Brian's name and likeness for commercial gain. I doubt they have consent or plan on paying royalties on the usage. That said, it's not like anyone's going to sue them for selling a few shirts.

I got a really nice Tom Waits t-shirt from them tbf - I think they must get around it cos they never seem to put any names on their actual t-shirts - they all seem to be homages with slightly more vague references and images (tho the Brian ones obviously not vague)

The fact they are using his name and the band to sell it makes it not cool. If they just used the image it would be passable but they are really trying to make money off their work. No buys!

hah, no bet! I was pretty sure it wasn't cool for them to be using his name/image but this confirms it.

they are selling a Brian Fallon t-shirt on the Revival Tour and that one is definitely authorised!

apparently it's a tour exclusive (£15) and when its gone its gone

the small print reads:
